Jurisdiction of Courts
Jurisdiction is the authority to adjudicate ie the authority to hear and determine a legal matter that is in dispute
Types of Jurisdiction
1. Original Jurisdiction
2. Appellate Jurisdiction
3. Supervisory Jurisdiction
1. Original Jurisdiction
A court has original jurisdiction worth a legal question if exercised at first instance ie the court that is authorised to hear such matter.
Appellate Jurisdiction
This arises when a court is adjudicating a matter on appeal.
Supervisory jurisdiction
This is exercised in a supervisory capacity by a higher court over a lower one ie the higher court send representatives to see how issues are handled in lower courts.
The 1999 constitution of the federal republic of Nigeria the supreme court has the original jurisdiction as well as appellate jurisdiction only in some cases. Court have original jurisdiction in any dispute between the federal and a state or between states if any in so far as the dispute involves any question whether of law or fact on which the existence or extent of a legal right or extent of a legal right depends g a dispute between a governor of a state and the president of the federation.
The original jurisdiction of the Supreme Court may be extended by an Act of the national assembly provided that the jurisdiction is not written any criminal matter.
